Description:

Employers often find themselves on the losing end of a workers' compensation claim even with a positive drug test because they were not adequately prepared to defend against the claim. Employers must have clear and effective policies in place prior to an injury before they can successfully defend against a workplace injury caused by employee intoxication. This session provides a step-by-step approach to dealing with a claim that results from employee intoxication. It also alerts employers to the pitfalls and common misconceptions surrounding post-accident drug testing requirements in Ohio, especially in light of the recent marijuana controversy.

Learning Objectives:
1. Recognize post-accident drug testing requirements for Ohio workers' compensation claims; 2. Describe how to prepare to defend workers' compensation claims before the injury occurs; and 3. List your options when you discover a positive post-injury drug test.
