What started out as a series of non-binding policy documents led two separate rulemaking initiatives, two promulgated rules, and two lawsuits challenging those rules. At long last, the industry should have clarity on the status of the workplace examination rule, but questions remain. This presentation chronicles the events surrounding changes to the workplace examination rule and provides a status update. Learning Objectives: 1. Define the new MSHA workplace exam rule. 2. Identify what recordkeeping is required. 3. Recognize the role of the contractor and mine operator regarding workplace exams.
