Unfortunately, while this is the law, a positive post-injury drug test does not mean an automatic denial of a workers’ compensation claim. The Ohio Industrial Commission has strict requirements that employers must meet before they can successfully deny a claim based on a positive drug test. This presentation will discuss how employers can successfully prepare their defense before an intoxication. Learning Objectives: 1. Define the elements of an intoxication defense. 2. Demonstrate how proper planning before an accident is the best strategy. 3. Describe the new medical marijuana legislation. 4. Identify the risks of medical marijuana in the workplace.
