Description:
Under Ohio law, a workplace injury is not compensable if it is caused by employee intoxication. Unfortunately, while this is the law, a positive post-injury drug test does not mean an automatic denial of a workers’ compensation claim. The Ohio Industrial Commission has strict requirements that employers must meet before they can successfully deny a claim based on a positive drug test. This presentation will discuss how employers can successfully prepare their defense before an intoxication.
